1. Agreement to these Terms

By accessing the application, creating an account, submitting content, approving a website preview or purchasing a service, you agree to these Terms and acknowledge our Privacy Policy. If you are using the service for a company or another person, you represent that you are authorized to accept these Terms on their behalf. You must be at least 18 years old and legally able to enter into a contract.

2. Services

Miami Web Graphics provides website design, automated website generation, hosting-related configuration, domain registration assistance, SSL and DNS configuration, email forwarding setup, content tools and account-management features. Features may differ by plan and may change as the service develops. A preview is provided so you can review the proposed design before checkout.

Search-engine audits, scores and recommendations are informational estimates. We do not guarantee rankings, traffic, sales, uninterrupted availability or a particular business result.

3. Accounts and security

You must provide accurate information, keep your password confidential and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures. We may request verification before making sensitive account, domain or billing changes.

4. Customer content and permissions

You retain ownership of text, logos, photographs and other materials you submit. You grant Miami Web Graphics a non-exclusive, worldwide, royalty-free license to host, copy, resize, optimize, display, transmit and otherwise process that content only as reasonably necessary to create, moderate, operate, maintain and support your website and the service.

You represent that you own or have permission to use every submitted item and that it does not violate copyright, trademark, privacy, publicity or other rights. You are responsible for the accuracy and legality of your business claims, offers, contact information and published content.

5. Acceptable-use and content standards

You may not upload, request, publish or use the service for content or activity that:

• is illegal, fraudulent, deceptive, defamatory or intended to facilitate wrongdoing;
• promotes hatred, discrimination, harassment, threats, humiliation or abuse against a person or group;
• contains pornography, sexual exploitation, non-consensual intimate material, sexual content involving minors, or any material that endangers children;
• depicts or glorifies extreme violence, cruelty, self-harm, human trafficking or abuse;
• impersonates another person or misrepresents affiliation, credentials or authority;
• infringes intellectual-property, privacy, publicity or contractual rights;
• contains malware, malicious code, phishing, spam or attempts to compromise the service;
• otherwise conflicts with the safety, dignity and professional standards of a public website.

We may use automated systems and human review to evaluate submitted text and images. Content may be approved, rejected, quarantined or referred for review. Automated systems can make mistakes; you may contact us to request reconsideration. We may preserve or report material when reasonably necessary to comply with law or protect people from serious harm.

6. Preview approval and publication

You are responsible for reviewing the full website preview, spelling, prices, services, images and contact information before approving it. Approval authorizes us to use the submitted configuration to prepare and publish the website after successful payment. You remain responsible for reviewing the live site and promptly reporting errors.

7. Prices, payment and Stripe

Prices and renewal terms are shown before checkout. Payments are processed by Stripe or another disclosed payment provider; Miami Web Graphics does not directly collect full payment-card numbers. Taxes, if applicable, may be added during checkout. You authorize the payment provider to charge the amount displayed and any clearly disclosed recurring renewal.

Except where required by law, charges for completed digital work, domain registrations and services already provisioned are non-refundable. If we cannot provide a purchased service, we may offer correction, replacement, account credit or a refund, as appropriate.

8. Domains and annual management

Domain availability is not guaranteed until registration succeeds. An eligible first-year domain is included only when the application confirms that its registration and renewal prices meet the displayed limit. A domain may become unavailable between search and payment; if that happens, we will request another selection or provide an appropriate remedy.

The application currently displays annual domain management at US$19.99 per year. The renewal process may begin before the domain expiration date to avoid service interruption. You can manage or cancel future renewal through the available billing tools. Cancellation does not reverse a registration or renewal already completed, and failure to renew can cause expiration or loss of the domain. Registry, registrar and ICANN rules also apply.

9. Third-party services

The service relies on third parties such as Cloudflare, Stripe, domain registries, email providers and optional artificial-intelligence or moderation providers. Their terms and privacy practices may apply to the portions they operate. We are not responsible for outages, policy decisions or failures outside our reasonable control, but we will make reasonable efforts to assist with issues affecting our service.

10. Intellectual property

Miami Web Graphics and its licensors retain ownership of the application, software, templates, interface, automation, documentation, brand assets and reusable design components. Your purchase gives you the right to use the delivered website for your business; it does not transfer ownership of the underlying platform, source code or reusable systems unless a separate written agreement says otherwise.

11. Suspension and termination

We may restrict or suspend service when reasonably necessary to address security risks, nonpayment, illegal activity, material violations of these Terms or threats to users or infrastructure. When practical, we will provide notice and an opportunity to correct the issue. You may stop using the application at any time, but outstanding charges and completed registrations remain payable.

12. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Miami Web Graphics will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, lost opportunities or reputational harm. Our aggregate liability arising from the service will not exceed the amount you paid to Miami Web Graphics for the affected service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnification

You agree to defend and indemnify Miami Web Graphics from third-party claims arising from your submitted content, your business activities, your violation of another person’s rights or your material breach of these Terms, except to the extent the claim results from our own unlawful conduct.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any mandatory consumer protections, disputes will be brought in the state or federal courts serving Miami-Dade County, Florida. Before filing a claim, each party agrees to make a good-faith attempt to resolve the issue informally.

16. Changes and general provisions

We may update these Terms to reflect new features, legal requirements or operational changes. The effective date will be revised, and material changes may be communicated through the application or email. Continued use after the updated Terms take effect constitutes acceptance where permitted by law. If one provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
